As a foreigner in Thailand, it can be difficult to understand your tax responsibilities, and the Revenue Department doesn’t take ignorance as an excuse when they come looking for their money. Do you have to pay Thai income tax?

In the majority of cases, whether or not you must pay income tax in Thailand each year typically depends on two things: Where your income comes from and where you spend your time throughout the year.

If you get income from a Thai source, such as a salary from an employer, rents from investment properties, or profits from a Thai business, you must pay income tax on this money. Even if you live outside Thailand, this income is Thai-sourced and thus liable for taxation.

If you spend more than 180 days in Thailand out of a calendar year, whether consecutive or not, you are considered a “Thai tax resident.” This means you must pay income tax on both your Thai-sourced income and foreign-sourced income brought into Thailand.

If either of the above applies to you, you must file a personal income tax return with the Thai Revenue Department, or risk fines and even prosecution in extreme cases.

What to know about income tax in Thailand

  • Previously, foreign-earned income would only be taxed if it was brought into Thailand the same year it was earned, so you could just wait a year to bring in money and avoid tax. However, the rule has been changed and that loophole is closed. Now any income that is earned from January 1, 2024 onward and brought into Thailand is taxable, regardless of when you bring it into the country.
  • Before you can file a personal income tax return, as a foreigner, you must obtain a Tax Identification Number (TIN). This puts you into the system and enables you to pay your taxes. You cannot file without a TIN, though you can still be penalized for not filing, so make sure you get one well before the filing deadline (see below).
  • The Thai tax year is the same as the calendar year. When the new year begins, you will need to file a tax return regarding all the income earned in the previous year, from January 1st to December 31st.
  • The Thai tax season runs from January to the end of March. This is the period during which you must file your return, with the deadline being the end of March for hardcopy filings or the first week of April for online filings.
  • You can file your return in person at the Revenue Department or online. There is an English language option when filing online, but the translations aren’t perfect and it’s easy to make mistakes when doing multiple calculations with various income streams. However, filing in person is not better, as it takes them much longer to process the paper documents, English language services are not guaranteed, and the staff will not help with calculations or deductions.
